The introduction of mediation in the divorce process was to enable the parties involved to discuss and analyse why there is a marital breakdown. Mediation takes away the acrimonious blameworthy system and installs a communicative more user friendly approach, in the hope that by discussing the problems the parties may be able to reconcile their differences therefore hoping that mediation can save marriages. Family mediation does not make divorce easier, rather it helps the parties to behave responsibly about it. Mediation was introduced into the divorce system by the Family Law Act 1996. However to conclude that mediation is the miracle worker is a fallacy. In answering this question I will highlight that the mediation process is not such a miracle worker after all.
